Criminal charges (January-November 2019)

Defamation and Insult - 21
Dessimination knowingly false information - 7
Incitement of discord - 4
Participation in the activities of a banned organization - 7

According to the Commitee on the legal statistics and special accounts of the state office of public Prosecutor of Republic of Kazakhstan:

the courts of the Republic of Kazakhstan completed 24 cases under Art. 174 of the Criminal Code of the Republic of Kazakhstan (Institution of social, national, generic, racial, class or religious discord) in the first half of 2019.

Including:
- 18  given sentences;
- 1 dismissal of the case.
26 people were accused, 19 of them were  convicted, 3  were acquitted.

 

- as of November 2019, 73 cases under Art. 174 of the Criminal Code of the Republic of Kazakhstan registered in the National Register of Pre-Trial Investigations. 60 cases  were sent to the court.

 

Civil charges (January-November 2019)

66 civil charges were brought against journalists and citizens for exercising the right to freedom of speech in January-November 2019

including 59 claims and suits for the protection of honor, dignity and business reputation.

The claimed amount of compensation for non-pecuniary damage - 100 million tenge.

Collected amounts of compensation for moral damage - 9 million 295 thousand tenge.

Appelants of civil claims to media: civil servants  – 18 , legal entities – 21, individuals – 20

Judgments rendered –  73  (including 4 – in the cassation, 20 - in the appeal). Of those in favor of the media and the citizens – 43.

 

Administrative charges (January-November 2019)

15 administrative charges were brought against journalists and citizens in January-October 2019:

Violation of legislation on rallies - 3

Disorderly conduct charges - 1

Disobedience to the lawful order of a representative of authority charges- 2

Beatings charges - 1

Violation of the legislation on elections in the Republic of Kazakhstan - 5

Breach of the migration legislation - 1

Violation of the order of stating masthead - 1

Publishing false information – 1
